Distance sales agreement

Buyer: the person whose details are given when the order is placed.

2. Subject

This agreement sets out the rights and obligations of the parties in accordance with Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation, in respect of the sale and delivery of the product whose qualities and price are stated in the order.

3. The product

The type, quantity, brand, model, colour and sale price of the goods are as shown on the order page and on the invoice, which forms an integral part of this agreement.

4. Delivery

The goods are delivered to the address given by the buyer within the period stated on the order page, and in any event within thirty days of the order. Delivery costs are borne by the buyer unless stated otherwise. Where the goods cannot be supplied, the seller notifies the buyer within three days and refunds the total sum within fourteen days.

5. Right of withdrawal

The buyer may withdraw from the contract within fourteen days of receiving the goods, without giving a reason and without penalty, by notifying the seller. The goods must be unused and in a condition fit for resale, in their original packaging, together with the invoice. The refund is made within fourteen days of the withdrawal notice.

6. Exceptions to the right of withdrawal

The right of withdrawal does not apply to goods prepared to the buyer’s specification or clearly personalised, to goods cut to size, or to opened packs of adhesive, chemical or hygiene products.

7. Default

If the buyer defaults on a payment made by credit card, the buyer is liable to the card-issuing bank under the terms of the card agreement. Where the seller is in default, the buyer may exercise the rights available under law.

8. Disputes

Consumer arbitration committees and consumer courts at the buyer’s or the seller’s place of residence have jurisdiction, up to the limits announced each year by the Ministry of Trade.

9. Effect

This agreement takes effect when the buyer confirms the order on the site. The buyer is deemed to have read and accepted all of its terms.
